Default Help!! Dealer Fraud?

My sister bought the car last year from the dealer. The car was 2008 model and she paid around $22,000 including warranty. At the time of sale, the dealer mentioned that the car is new and has only 18000 KMs on it and gave a "used discount" of 3000.

My sister recently went on mat leave and was looking to sell the car to raise some money. After she was unsuccessful, I decided to help her out and found out through a prospective client that the car was involved in accident. I didn't trust the client so pulled carproof report and it confirmed that the car was involved in major accident which costed around 10,000 dollars to have front side fixed.

My entire family is shocked to hear that the dealer sold us a car that was in collission. We can no longer sell the car at the right value as no one would want to give a reasonable price for vehicle that has been in collission.

I would like you guys to help us out to see if we can do any thing to sue the h.... out of the dealer. My sister would have never bought the car ahd she known that the car was involved in collission. Also no sane person would have made that choice at that price. I cannot give the details of the car but the new 2011 model costs 17000!!!

So it was a used car a year old with 18,000 miles. Did the paper work have any declarations? It should have stated that the car sustained over $xxxxx in damages, here it's over $2,000, which pretty much is a scuffed bumper now a days.

I don't see how the paper work can state "new" if it's got 18,000 miles. Unless it actually states that it's "new", or that it has no accidents, I don't think you have a leg to stand on.

I'm not sure...

I know in buying a house if you don't tell someone about a problem like, say, a water leak, and sell the house...you're up a certain creek.

If the car was properly repaired then IMO not a big deal.

I know here if a dealer sells a car that is "new". it MUST state that on the bill of sale, otherwise it's just a "used" car. A used car may have an accident history. We had a dealer sell a "new" car to a woman, had just a couple of miles on it, and several months when the sliding door wouldn't stay closed, or stay fixed, it was discovered that the "new" car had several thousand dollars of damage. The dealer told her, tough, and she went to the media. The dealer refunded her money.

Up here a "new" car is one that has never been registered to the consumer. So a dealer may have a car that is used as a demo and never registered to the consumer. So if they sell that car, even if it has 18,000 miles, it can still be considered "new". That said, I've never seen a demo with that kind of miles, I don't why a dealer would allow that kind of miles to get clocked on a "new" car, they would sell it before then. So that's why I believe it's just a "used" car. Check the bill of sale to see what they sold you.
